Terms of Service

1. Introduction & Acceptance
These Terms of Service ("Terms") govern your access to and use of MoldMaker's website, Blender add-on, and cloud SaaS platform (collectively, the "Service"), operated by MoldMaker Inc. ("MoldMaker", "we", "us", or "our").
By creating an account, downloading the Blender add-on, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility & Accounts
You must be at least 16 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@moldmaker.io if you suspect unauthorized access.
3. Service Description
MoldMaker provides software tools that convert user-supplied 3D mesh files into mold geometry (mold halves, alignment keys, pour spouts, vents) and related outputs such as volume estimates and bounding-box metrics. The Service does not guarantee the manufacturability, structural integrity, or fitness for any specific casting application of generated mold designs. Users are solely responsible for testing and validating outputs before use.
The Blender add-on may operate fully locally (no data transmitted) or in a cloud-connected mode ("Send to Cloud") that submits your model to our servers for processing. The cloud web application always transmits model data to our servers.
4. User Content & License
You retain full ownership of the 3D models you upload and the mold outputs generated from them.
By uploading content to the Service, you grant MoldMaker a limited, non-exclusive, worldwide, royalty-free license to: (a) store, process, and transmit your content solely to provide the Service; (b) use aggregated, anonymized metadata (e.g., file size ranges, processing times) to improve system performance; and (c) retain temporary copies as needed for job queuing and delivery.
You represent and warrant that you have all rights necessary to upload your content and that it does not infringe any third-party intellectual property rights, violate any law, or violate any person's rights.
You may not upload content that depicts, enables, or facilitates the manufacture of illegal weapons, controlled items, or items regulated for production under applicable law.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble any part of the Service.
- Circumvent job quotas, file size limits, rate limits, or other usage controls.
- Use automated scripts to create accounts, scrape outputs, or abuse the Service.
- Use the Service for any illegal activity or to violate the rights of others.
- Resell or redistribute access to the Service without a written agreement.
- Upload content that is unlawful, harmful, or infringes third-party IP rights.
6. Subscriptions, Payments & Refunds
Paid plans are billed on a monthly or annual basis, beginning on the date you subscribe. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period and no further charges will be made.
Payments are processed by Stripe, Inc. By subscribing, you also agree to Stripe's Terms of Service. All prices are in USD and exclusive of applicable taxes. We reserve the right to change prices with 30 days' notice.
We offer a 14-day free trial on Creator and Studio plans. Refund requests outside the trial window are evaluated on a case-by-case basis. Contact billing@moldmaker.io.
The standalone Blender add-on is sold as a one-time purchase. We do not provide refunds after the add-on has been downloaded and activated, except where required by applicable consumer protection law.
7. Intellectual Property
The MoldMaker software, website design, brand assets, and documentation are the exclusive intellectual property of MoldMaker Inc. Nothing in these Terms grants you a license to copy, redistribute, or create derivative works of our software outside of the personal, non-transferable license granted by your active subscription or purchase.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR INTENDED CASTING APPLICATION.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOLDMAKER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify, defend, and hold harmless MoldMaker and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service; (b) your uploaded content; or (c) your violation of these Terms.
11. Modifications & Termination
We may modify these Terms at any time. Material changes will be communicated via email or prominent in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice, at our sole discretion.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for IP-related matters.
